V\u00e9rification des titres et inscriptions au registre"},"content":{"rendered":"\n<ul class=\"wp-block-list\">\n<li>Avant de conclure toute transaction et pr\u00e9f\u00e9rablement t\u00f4t au cours du processus, demander \u00e0 une soci\u00e9t\u00e9 de v\u00e9rification de titres, \u00e0 un avocat ou \u00e0 un notaire de v\u00e9rifier le titre de chaque propri\u00e9t\u00e9 ou accord de conservation que l\u2019organisme de conservation a l\u2019intention d\u2019acqu\u00e9rir.\n<ul class=\"wp-block-list\">\n<li>Mettre le titre \u00e0 jour au moment de conclure la transaction ou juste avant.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>\u00c9valuer toute charge ou exception affectant le titre de propri\u00e9t\u00e9 et documenter les dispositions prises par l\u2019organisme de conservation \u00e0 l\u2019\u00e9gard des hypoth\u00e8ques, privil\u00e8ges, droits miniers et autres droits grevant la propri\u00e9t\u00e9 avant de conclure la transaction.\n<ul class=\"wp-block-list\">\n<li>Les hypoth\u00e8ques, privil\u00e8ges et autres charges qui pourraient causer l\u2019extinction de l\u2019accord de conservation ou qui pourraient nuire de mani\u00e8re consid\u00e9rable aux valeurs de conservation importantes de la propri\u00e9t\u00e9 doivent \u00eatre \u00e9teints ou subordonn\u00e9s de mani\u00e8re ad\u00e9quate \u00e0 l\u2019accord de conservation.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Enregistrer rapidement les documents relatifs aux transactions fonci\u00e8res et d\u2019accords de conservation, incluant les rapports de documentation de base ou les sommaires de rapport de documentation de base au bureau d\u2019enregistrement appropri\u00e9.<\/li>\n<\/ul>\n\n<h4 class=\"wp-block-heading\">Contexte<\/h4>\n\n<p class=\"wp-block-paragraph\">Le terme \u00ab titres \u00bb signifie la preuve de la propri\u00e9t\u00e9 ; c&#8217;est la documentation l\u00e9gale du droit d&#8217;un propri\u00e9taire sur la propri\u00e9t\u00e9. Avant de s&#8217;engager dans l&#8217;acquisition de terres ou la conclusion d&#8217;accords de conservation, un organisme de conservation doit s&#8217;assurer qu&#8217;il n&#8217;y a pas de probl\u00e8mes de titres qui pourraient compromettre les valeurs de conservation importantes de la propri\u00e9t\u00e9 ou restreindre consid\u00e9rablement son utilisation. L&#8217;organisme de conservation doit rechercher le titre de propri\u00e9t\u00e9 le plus t\u00f4t possible au cours du processus de n\u00e9gociation afin d&#8217;\u00e9viter tout probl\u00e8me ult\u00e9rieur. S\u2019ils le souhaitent, les organismes de conservation peuvent faire signer aux propri\u00e9taires une lettre d&#8217;intention les emp\u00eachant d&#8217;imposer de nouvelles restrictions sur le titre de propri\u00e9t\u00e9 pendant le processus de n\u00e9gociation. Un organisme de conservation doit identifier les propri\u00e9taires, les int\u00e9r\u00eats li\u00e9s \u00e0 la propri\u00e9t\u00e9, l&#8217;\u00e9tat des paiements des imp\u00f4ts fonciers, les privil\u00e8ges, les hypoth\u00e8ques ou autres charges financi\u00e8res, les accords de conservation, les droits de passage, les droits sur l&#8217;eau, ainsi que toute autre r\u00e9clamation ou condition pouvant affecter le titre de propri\u00e9t\u00e9. L\u2019organisme doit ensuite \u00e9valuer ces \u00ab exceptions \u00bb pour d\u00e9terminer lesquels pourraient affecter sa capacit\u00e9 \u00e0 prot\u00e9ger la propri\u00e9t\u00e9 et agir en cons\u00e9quence.
